Tobacco License

Note: The City allows a maximum of four (4) Tobacco Store Licenses, with no limit on Retail Establishment Licenses. Starting March 17, 2025, no new Tobacco Store Licenses will be issued if the cap is met, as outlined in Hastings City Code Section 112.03M. Only licenses issued before this date will be eligible for renewal. Renewals are limited to the same individual license holder as of March 17, 2025, or to the same business entity, provided there has been no change of 50% or more in ownership since that date.

The sale of tobacco and related products in the City of Hastings is regulated to protect public health and comply with state and local laws. Any business or establishment selling tobacco, tobacco-related devices, electronic delivery devices (e-cigarettes/vapes) or nicotine products must obtain a Tobacco License from the City before operating. 


Who Needs a Tobacco License?

A City of Hastings Tobacco License is required for any retailer that sells or offers for sale:

  • Cigarettes and cigars

  • Chewing tobacco and snuff

  • Electronic delivery devices (e.g., vapes, e-cigarettes)

  • Nicotine products not regulated by the FDA for cessation

  • Tobacco-related devices (pipes, rolling papers, etc.)

A separate license is required for each location where tobacco products are sold.


Licensing Requirements

To obtain a tobacco license in Hastings, applicants must:

  1. Complete the Tobacco License Application

  2. Submit the following:

  3. Pay the investigation and license fee

  4. Applications must be approved by the City Council before a license is issued. Please allow 2–4 weeks for processing.


License Duration & Renewal

  • Tobacco licenses are valid July 1 through June 30 of each calendar year

  • Renewal applications must be submitted before the current license expires

  • Failure to renew on time may result in a lapse in licensure and enforcement actions


Compliance & Enforcement

License holders must comply with all applicable:

  • City of Hastings ordinances (including minimum age sales restrictions)

  • Minnesota Statutes, Chapter 461

  • Federal laws regarding tobacco sales and packaging

Routine compliance checks are conducted in partnership with law enforcement. Violations may result in fines, suspension, or revocation of the license.

The legal minimum sales age for tobacco in Minnesota is 21 years old.
