Fireworks Sales License

Retail sales of fireworks within the City of Hastings are regulated to ensure public safety and compliance with Minnesota state law. Businesses or individuals intending to sell legal consumer fireworks must obtain the appropriate licenses from both the State of Minnesota and the City of Hastings.

What Fireworks Are Legal in Minnesota?

Under Minnesota Statutes § 624.20 – 624.25, only certain types of fireworks are permitted for sale to consumers, including:

• Sparklers
• Cones and tubes that emit sparks
• Novelty items (e.g., snakes, party poppers)

Prohibited Items: Aerial fireworks, firecrackers, bottle rockets and other explosive or projectile devices are not legal for consumer use or sale in Minnesota.

Who Needs a Retail Fireworks Sales License?

Any person, business or organization that plans to sell consumer fireworks at retail within Hastings must obtain a Retail Fireworks Sales license prior to beginning operations.

This applies to both retail stores and seasonal/temporary sales locations (e.g., tents, stands). 

Application Process

1. Submit City Application:

   • Complete the Retail Fireworks Sales License Application

   • Provide a site plan showing:

     • Sales location

     • Distances from nearby structures, streets and lot lines

     • Fire extinguishers and safety measures

   • Provide a list of the proposed amount of fireworks:

     • Documenting the name, weight and quantity of fireworks

   • Associated Material Safety Data Sheet (MSDS) Sheets

   • Written Authorization from the property owner for the applicant's use of the property for the sale and/or storage of permitted fireworks

   • If the applicant does not own the business premises, attach a true and correct copy of the current executed lease. 

2. Pay the License Fee: Refer to the City Fee Schedule for current rates.

3. Inspection: The Fire Department must conduct a site inspection before issuing final approval.

4. License Approval: Once approved, your City fireworks license will be valid for the sales period specified within the application

Safety & Compliance Requirements

All retail fireworks operations must comply with:

• City of Hastings Ordinances

• State Fireworks Safety Code

• Age verification: Sales only to individuals 18 years or older

• Seasonal tents/stands must also meet structural and fire code requirements.

License Duration

City fireworks licenses are valid for a specific sales period. License holders must reapply each year.
