Minnesota Child Passenger Safety Laws
Every driver transporting a child under the age of 18 in a motor vehicle is required to ensure that the child is properly secured using a car seat or seat belt. All child passenger restraint systems must meet federal safety standards and be installed and used according to both the car seat manufacturer's and the vehicle's instructions.
General Requirements
- Age and Height Requirement: Children under age 8 and shorter than 4 feet 9 inches (4'9") must be secured in a federally approved child safety or booster seat. If a child reaches 4'9" before age 8, they can legally ride in an adult seat belt.
- Driver Responsibility: The driver is responsible for ensuring all passengers are in the proper restraint.
- Back Seat Mandate (Best Practice): Children under 13 years old must sit in the back seat, if possible.
- Stricter Rule Applies: If a child fits into more than one category, they must be placed in the restraint that offers greater protection (the safer restraint).
Guidelines by Child Restraint Phase
Minnesota law follows best practice guidelines that encourage caregivers to keep children in each restraint phase until they reach the maximum height or weight limit of the specific car seat model.
Rear-Facing Car Seat
- Requirement: Birth to at least 2 years old.
- Restraint Type: Infant or convertible car seat.
- Transition: Keep the child rear-facing until they outgrow the seat's height or weight limit.
Forward-Facing Car Seat
- Requirement: At least 2 years old AND has outgrown the rear-facing seat by height or weight.
- Restraint Type: Forward-facing car seat with an internal harness.
- Transition: Keep the child forward-facing with a harness until they outgrow the seat's height or weight limit, which typically occurs around age 4.
Booster Seat
- Requirement: At least 4 years old AND has outgrown the forward-facing seat with internal harness by height or weight.
- Restraint Type: Booster seat using the vehicle's lap and shoulder belt.
- Transition: Keep the child in a booster seat until they are at least 9 years old OR have outgrown the booster seat and can pass the Five-Step Test.
Vehicle Seat Belt (Adult Belt)
- A child can transition to using a standard vehicle seat belt once they are at least 9 years old, or have outgrown the booster seat, and successfully pass the Five-Step Test.
The Five-Step Test for Seat Belt Readiness:
(The child must meet all of these criteria for the entire ride)
- The child sits all the way back against the vehicle seat.
- The child's knees bend comfortably over the edge of the vehicle seat.
- The lap belt fits snugly across the hips near the top of the thighs (not the abdomen).
- The shoulder belt crosses snugly over the center of the chest and shoulder (not the neck).
- The child can sit correctly without slouching for the duration of the trip.
